1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you and DeskPety (Independent Developer) (“we,” “us,” or “our”), concerning your access to and use of the deskpety.com website.

2. Freemium Model and Subscriptions

DeskPety operates on a Freemium model. We provide a basic tier that is permanently free. Upgrading to DeskPety Pro grants access to premium features, such as unlimited classrooms, Academic Checks, and pre-written comment banks.

3. User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. Features such as the interactive sandbox demo are provided for trial purposes, but saving permanent classroom data requires registering a formal account via Google OAuth.

4. Limitation of Liability and “AS IS” Disclaimer

DeskPety and all related services are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties, express or implied. We do not guarantee continuous, uninterrupted access to the platform.

6. Commercial Use of Generated Assets

Free and Pro plan users are granted a personal, non-transferable license to use generated materials (including but not limited to worksheets, prompts, and cliparts) strictly for their own classroom or personal educational purposes. Any commercial distribution, resale, or publishing on marketplaces (e.g., Teachers Pay Teachers) requires an active Max Plan subscription. DeskPety reserves the right to suspend or terminate accounts found violating this commercial usage boundary.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China, without regard to its conflict of law provisions.
